Memorandum of Understanding

Between The Texas NAACP And Texas Guaranteed Student Loan Corporation

This Memorandum of Understanding (MOU) sets forth the mutual understanding and present intentions of the Texas National Association for the Advancement of Colored People (Texas NAACP) and Texas Guaranteed Student Loan Corporation (TG) to participate in certain of each other's existing programs and to develop new resources to promote post-secondary education opportunities for African-Americans, remove obstacles to education beyond high school for these individuals, and increase the number of African-American students who complete a post-secondary education. TG supports Texas' Historically Black Colleges and Universities in their efforts to implement institutional default aversion management plans and supports the activities of the Texas HBCU Consortium.

The Texas NAACP and TG believe that a higher education has significant socio-economic benefits that can greatly enhance the lives of minority students, their families, and society as a whole, and to that end, the Texas NAACP and TG agree to work together to pursue the following initiatives:

  • Annual Conference - Attend the annual conference/convention of each organization, and, as may be mutually agreed upon, provide informational exhibits and/or conduct sessions or training activities for conference participants.
  • Texas Awareness Initiative - The Texas NAACP will endeavor to participate in the meetings and projects of the Texas Awareness Initiative, a coalition of institutions and organizations focusing on pre-college outreach efforts in Texas.
  • Promote Higher Education - Jointly design, develop and produce a multi-media college promotion campaign which may include, but not be limited to, a poster and related brochure.
  • Radio PSAs - Jointly produce a public service announcement for radio broadcast. The parties would send the PSAs to Texas radio stations and seek their broadcast solely as community service messages. The parties would not seek to purchase air time or advertisement space for the PSAs.
  • Back to School Stay in School - TG will endeavor to conduct certain college awareness activities during the Back-To-School/Stay-In-School (BTS/SIS) Program of Texas NAACP. The mission of this program is to increase the number of skilled, literate youth graduating from high school by providing them with mentoring, tutoring, remedial assistance, and incentives for maintaining regular attendance, thus creating a more attractive approach to education. TG would provide support to this program through mentors, tutors, subject matter experts and informational materials.

This MOU does not affirmatively bind the parties to undertake the actions set forth herein, but merely serves as evidence of the parties' good faith intentions with regard to these activities. In the event that the parties agree to develop for both their use any materials such as posters, brochures, PSAs and the like, the terms of such development, including but not limited to payment obligations and ownership of the created materials, shall be mutually agreed upon by the parties, reduced to writing, executed by both parties, and attached to this MOU.

This MOU shall be effective on the date it is last signed by the parties. Either party may terminate this MOU upon five days prior written notice to other party. This MOU shall terminate one year after its effective date if the parties have not taken steps to pursue any of the initiatives set forth herein.

This MOU shall be governed by the laws of the State of Texas and is subject to all applicable state and federal laws.

This MOU contains the entire understanding and present intentions of the parties and supersedes any and all previous agreements or understandings they may have regarding this subject matter, whether orally or in writing.
